A 79-year-old driver is accused of travelling down the wrong side of the AP-7 motorway because he did not want to pay the €5.50 toll.
It comes after chaotic scenes were pictured on the main Costa del Sol highway on Sunday night between Calahonda and Marbella.
The Moroccan national travelled an incredible 13km at high-speed in the wrong direction late at night, forcing other vehicles to swerve out of his way.
According to police sources cited by Malaga Hoy, the sole intention of the man, who is resident in Madrid, was to avoid paying the motorway toll.
While he tested negative for alcohol and drugs, he is now being investigated for dangerous driving.
The incident unfolded just before 11.30pm, at a time when visibility was reduced and traffic, although lighter, was still flowing.
Several witnesses contacted 112 Andalucia to report that a vehicle was travelling at excessive speed on the wrong side of the lane.

‘He almost killed someone to avoid paying the toll,’ a witness said.
The emergency coordination centre alerted the Guardia Civil Traffic Unit, which managed to intercept the vehicle at kilometre 1,038 of the AP-7 in Marbella.
No injuries or further accidents were reported.
The Malaga-Marbella section of the AP-7 toll roads costs around €9 in high season and €5.50 in off season.
