A 34-year-old Danish man died on Friday after being found unconscious in a swimming pool in Marbella.
Emergency services were alerted at around 4.05pm when witnesses reported a man floating in the water with a head injury.
Despite resuscitation attempts, he was pronounced dead at the scene, situated in a residential complex in Nueva Andalucia.
According to reports in Diario Sur, the victim had travelled to Marbella with a friend. The pair allegedly entered the pool area without permission, where they spent the afternoon playing around in the water and consuming narcotics.
At one point, the friend realised that the man had been submerged for too long. He jumped in to pull him out but was unable to save him.
Autopsy rules out foul play
The case was initially investigated by Marbella’s Court of Instruction No. 5, but the autopsy results suggested an accidental death, prompting the judge to archive proceedings.
The man’s companion, who had been briefly detained following the incident, was released without charge. The judge ruled that there was insufficient evidence to suggest any criminal responsibility.
The Superior Court of Justice of Andalucía (TSJA) confirmed that the provisional closure of the case was based on the initial medical findings, though the court is still awaiting the final autopsy report to fully determine the cause of death.
The man had only recently arrived on holiday.
Police have reminded visitors that swimming while high on drugs or alcohol can carry serious risks.
